The European Commission will begin enforcing the Artificial Intelligence Act’s transparency obligations on Sunday, August 2, marking a major milestone in the bloc’s regulatory approach to artificial intelligence. The rules under Article 50 of the AI Act require providers and deployers of certain AI systems to inform users when they are interacting with AI or consuming AI-generated content.
The European Commission’s AI Office, working alongside national market surveillance authorities, will be responsible for implementing, supervising and enforcing the new rules. The Commission published detailed guidelines on Friday to help companies and organisations meet their obligations before the enforcement date. “From 2 August 2026, the European Commission’s AI Office, together with national authorities, will begin enforcing the Artificial Intelligence Act,” the Commission stated.
The transparency rules represent the most widely applicable section of the AI Act to date. They apply not only to providers of generative AI systems but also to deployers using AI chatbots, content generators, and emotion-recognition systems. Providers must clearly label AI-generated text, images, audio and video content. Chatbots and similar interactive AI systems must disclose their artificial nature to users.
Penalties for non-compliance are significant: fines of up to EUR 15 million or 3% of a company’s worldwide annual turnover, whichever is higher. Unlike most other provisions of the AI Act, the transparency obligations apply instantly to all systems without a transition period for new market entrants. However, the AI Omnibus package, approved by co-legislators in May 2026, grants providers of generative AI systems already on the market until December 2, 2026 to comply with the Article 50 marking requirements.
The rules complement the Code of Practice on Transparency of AI-generated Content, a voluntary framework developed by industry stakeholders to operationalise the transparency principles. The Commission’s guidelines clarify how interactive and generative AI systems must be labelled and how providers should implement content marking.
The enforcement launch comes as the EU positions itself as the global leader in AI regulation. The AI Act, which entered into force in stages starting in 2024, is the world’s first comprehensive legal framework for artificial intelligence. After August 2, most remaining provisions of the Act will begin to apply, including enforcement powers for both the Commission and national authorities.
The rules have drawn mixed reactions from the technology industry. Larger firms have generally adapted their systems ahead of the deadline, while smaller developers and open-source AI providers have raised concerns about compliance costs and technical complexity. Digital rights advocates have welcomed the rules as a crucial step in protecting citizens from AI-powered deception and manipulation.
