President Donald Trump lashed out at U.S. Attorney Jeanine Pirro on Friday after the Justice Department abruptly dropped felony vandalism charges against former Olympic athlete David Hearn, who had been accused of deliberately damaging the Lincoln Memorial Reflecting Pool.
The dramatic reversal came after federal prosecutors acknowledged in court filings that the damage to the iconic pool was caused by a “flawed installation” carried out by a contracted renovation crew, not by any act of vandalism. The DOJ concluded there was insufficient evidence to prove Hearn intentionally harmed the landmark reflecting pool.
Trump took to social media to express his displeasure with Pirro, a longtime ally whom he had appointed as the interim U.S. Attorney for the District of Columbia. “I disagree 100 percent with what Jeanine did,” Trump told reporters. “I don’t agree with her decision at all. That pool was vandalized, and everyone knows it.”
The case had drawn national attention when it was first announced, with the Trump administration framing the Reflecting Pool damage as an act of political vandalism. Hearn, a former Olympic swimmer, was arrested and charged with a felony count of destruction of federal property. The charges carried potential penalties of up to 10 years in prison.
However, the case fell apart after investigators discovered that the renovation contractor hired to perform routine maintenance on the pool had installed certain components incorrectly, leading to structural damage that prosecutors initially attributed to deliberate sabotage. Internal DOJ memos reportedly showed that career attorneys had raised concerns about the case from the beginning.
Pirro defended her office’s decision in a brief statement, saying the evidence simply did not support continuing the prosecution. “As prosecutors, we are ethically obligated to dismiss charges when we determine that the evidence no longer supports them,” Pirro said. “The forensic analysis clearly indicates the damage resulted from installation errors.”
The episode has exposed rare public tensions between Trump and one of his most vocal defenders in law enforcement. Pirro, a former Fox News host and longtime Trump loyalist, had been seen as a reliable ally in the administration’s aggressive law enforcement agenda. Trump’s public rebuke signals growing frustration within the White House over what some officials privately describe as a series of embarrassing legal defeats.
Legal analysts said the dismissal underscores the risks of allowing political considerations to drive prosecutorial decisions. “When cases are built around a political narrative rather than evidence, this is what happens,” said one former federal prosecutor who spoke on condition of anonymity. The Reflecting Pool, which stretches 2,029 feet between the Lincoln Memorial and the Washington Monument, has been a centerpiece of American national ceremonies and protests since its completion in 1922.
